Terms and Conditions

These Terms and Conditions ("Agreement") govern the use of the Book & Swap website (www.bookandswap.com) and the services provided therein. By accessing or using the Website, you agree to be bound by this Agreement. 

  1. Services Offered

Book & Swap operates as a barter system for professional accommodation providers ("Hosts"). It allows registered members ("Members") to request accommodation at registered establishments in exchange for BarterCoins™, earned through the use of the platform.

  1. Membership Requirements and Eligibility

To become a Member of Book & Swap, you must be a professional accommodation provider and should be listed on booking platforms or have a website for your establishment. Membership is subject to approval, and Book & Swap reserves the right to reject applications at its discretion.

  1. Quality Control

Book & Swap endeavors to maintain a high standard but is not involved with any quality grading and guest members must ensure that establishments meet their personal standards. Complaints about star grading should be addressed to the Tourism Grading Council.

Book & Swap may take appropriate actions against Hosts who consistently receive negative feedback from Members.

  1. BarterCoins™

Book & Swap provides all registered members with a restricted and revocable license to utilize its services, subject to adherence to the terms and conditions.

20 BarterCoins™ will be allocated to your account upon registration as a member of Book & Swap. Each year the subscription is renewed a further 20 BarterCoins™ will be allocated to your account.

Members have the right to request free accommodation at any of the registered establishments in exchange for BarterCoins™. The approval of this request is solely at the discretion of the Host Establishment.

Members can earn additional  BarterCoins™ by providing accommodation to other Members. BarterCoins™s can be used at any establishment listed on the Book and Swap platform. The number of BarterCoins™ charged per person per night may differ from establishment to establishment dependent on grading, location and prestige, and Members can see the number of BarterCoins™ charged by each member before a request is sent. Members can also earn 4 extra BarterCoins™ for every new member referred. Your BarterCoins™ never expire as long as you remain a paid-up member of Book & Swap. 

  1. Additional Extras and Charges

Hosts may charge additional fees for extras like meals, beverages and services.  Any additional charges should be clearly communicated to the Member before confirming the booking.

  1. Cancellation Policy

Once a swop (accommodation exchange) is accepted and confirmed by both parties, it constitutes a legally binding contract that must be honoured. Hosts are under no obligation to accept booking requests, but once confirmed, it constitutes a legally binding contract and as such must be honoured by the host and guest, and may not be cancelled outside the free cancelation period  unless agreed upon by both parties.

If a Host cancels a booking outside the cancellation period, they must make reasonable efforts to arrange suitable alternative accommodation for the affected Member unless it is mutually agreed upon by both parties.

If a guest cancels a booking outside the cancellation period or does not show up, the applicable number of  BarterCoins™ for the exchange will be forfeited, and the host will earn the BarterCoins™, as the room could have been sold to paying guests.

  1. Cancellation or termination of Membership

No refunds will apply upon termination of membership.

In the event of the establishment being sold, an ownership change, or the establishment closing down, the administrators should be notified. The member may then retain his/her unused BarterCoins™ for the remainder of his current membership period, providing that membership fees are up to date.

The administrators retain at their sole discretion to terminate any membership due to abuse of, or non-compliance with any terms and conditions herein set out without any refund.

The administrators retain at their sole discretion to remove the listing from the website due to multiple complaints about the standard of services and facilities offered. Such members will be allowed to retain his/her unused BarterCoins™ till the end of his/her membership has been paid.

Should a member fail to renew his/her membership by paying the annual membership fee within 30 days from the invoice date, he/she will lose all remaining BarterCoins™ that may have been accrued to date.

The administrators retain at their sole discretion the right to terminate any membership due to breach of trust, with immediate effect.

  1. Intellectual Property

All content provided on the Website, including but not limited to logos, trademarks, text, images, graphics, and software, is the property of Book & Swap and is protected by applicable copyright and intellectual property laws.

  1. Privacy

Book & Swap takes user privacy seriously. Please refer to our Privacy Policy https://app.bookandswap.com/privacy-policy to understand how we collect, use, and disclose personal information.

  1. Disclaimer of Warranty

Book & Swap provides the Website and its services on an "as is" and "as available" basis. We do not guarantee the accuracy, completeness, or reliability of any information on the Member Websites. Users access and use the Website at their own risk.

  1. Limitation of Liability

Book & Swap and its affiliates shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from the use or inability to use the Website or its services.

  1. Amendments

Book & Swap reserves the right to modify, update, or discontinue any part of these Terms and Conditions at any time without prior notice. It is the Member's responsibility to review the Agreement periodically for changes.

  1. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of laws principles.

By using the Book & Swap website as a member, you acknowledge that you have read, understood, and agreed to be bound by these Terms and Conditions.
